will a Motorola MTX 838(looks like a mtx 8000) model # H01UCC6DF3AN do talkaround i need to know for local P.D.

Yes, factory set for a maximum of 10 conventional channels, or 15 talkgroups, or a combination of both.

the only thing i can program mine with is the mtsx LAB. But i have 99 channels with the continuous rotary(only reason i have it). My 2 position switch under the channel selector is set up to do TA.

Note that many "Privacy Plus" radios will not do the so-called "821 Channels" (866-869 and 821-824).

the ones i have do 823.XXXX and up maybe down to so is it just some of them that do that or all??

I don't know for sure.
The PP radios I'm most familiar with are MTX8000 and MTX8250, and none of the ones I've seen (which is quite a number) will accept an 821 channel either for conventional or a control channel, though they will track to an 821 channel for voice in response to an OSW.
Interestingly enough, the STX radios I've encountered will accept 821 channels.
So I don't think there has been a consistent policy. In general, the 821 channels are limited to public safety, so (in theory) there is no point in including them in a commercial radio. But then rigid consistency has never been a Motorola trademark.

All of the MTX8000 that I have programmed have been able to accept the 821.XXX freqs. Not to say that they weren't "played" with before I got them from Fleabay..

Yes, very likely played with. RKG is correct, a factory MTX8000/838 will not do the PS portion of the band (821-824, 866-870) by default. You must either modify the bandsplit in the MTSX.ODB file, or use a version of LAB to enable that feature in the radio. Other than the 'MTX838' sticker on the front, the radio is identical in every way to the MTX8000.
The STX radios were considered 'Public Safety' grade radios, and could do the PS freqs regardless if they were SmartNet capable or not.
